Divorce in Barcelona

In short

If you are looking for a divorce lawyer (or a divorce solicitor) in Barcelona, the first thing is to know which route applies to you: divorce is decreed at the request of one spouse alone, of both, or of one with the consent of the other. This page is general information and is not legal advice. If there is a risk to your safety or your family's, call the emergency services first and then look for legal help.12345678910111213

By mutual agreement or contested: what changes

In a divorce by mutual agreement, a claim is filed that includes a regulatory agreement (convenio regulador), as the Generalitat states.3 If only one spouse asks for the divorce without the other's consent, the judge decides directly.3

When there are dependent children who are minors and not emancipated, or whose capacity has been modified by a court, the regulatory agreement must be submitted to the judicial authority for approval.1 In that case it is worth asking the lawyer how the parenting plan is prepared, which must set out each parent's commitments on custody, care and education of the children.1

The risks of each route, plainly put: mutual agreement depends on both of you agreeing on the agreement, and if you do not, the decision passes to the judge. The official sources we have reviewed give no durations or costs for either route, so this page does not state them. Be wary of any firm that promises you a result or a deadline without knowing your case.

Notarial route or before the court clerk, and when a lawyer is needed

If there are no dependent children who are minors or whose capacity has been modified, the spouses can draw up the agreement before a court clerk (letrado de la Administración de Justicia, LAJ) or in a public deed before a notary.1 The Generalitat states that, if it is by mutual agreement and there are no children under age, a notary can also authorise the divorce or separation.3

In this route the spouses appear in person, assisted by a practising lawyer, and express their unequivocal wish to separate or divorce.1 In other words, even if you do not go to court, in the route before the LAJ or the notary you do need a practising lawyer to assist you.1

A risk to bear in mind: according to the sources cited, this route requires that there are no children in the situation described1 and that the divorce is by mutual agreement.3 If either of these changes, the route has to be reconsidered with your lawyer.

When to consult a lawyer

  1. A legal deadline is running: if you have received a notification or a procedure has started, consult soon rather than wait. This page does not state specific deadlines for a divorce, so ask the lawyer which ones apply in your case.
  2. There is a risk to your safety or your family's: go to the emergency services first. Legal help comes afterwards.

Outside those cases, consulting is your choice and not an obligation: you can look into it calmly, and a lawyer does not replace what you and the other person decide.

What to bring to the first consultation

To make the most of the first consultation, it helps to bring:

  • Your DNI or NIE and, if you have it, the family book or the marriage certificate.
  • Details of your children, if any: ages and who they live with now.
  • A written summary of what you have already discussed or agreed with the other person.
  • Any document you have signed before about the home, the accounts or the children.

And questions worth asking before hiring:

  • Which route suits your situation and what risks it carries.
  • How the service is charged, what it includes and what it does not, and that they give it to you in writing.
  • Who will handle your case and how they will keep you informed.

Neither of these lists replaces what the lawyer tells you about your specific case.

How to check a lawyer with the ICAB

Before hiring, check that the person is registered in the professionals search of the Il·lustre Col·legi de l'Advocacia de Barcelona (ICAB). Search for their name and verify that they appear as a practising member. This page does not certify any lawyer or recommend anyone in particular.

If something does not seem right, for example a promise of a result, ask for clarification before signing. Hiring is your decision and you can ask for time to think it over.

Frequently asked questions

Does anything change if I am looking for a lawyer for a separation instead of a divorce?

The sources we have reviewed treat separation and divorce together in the route before the court clerk (letrado de la Administración de Justicia) or the notary, where the spouses express their unequivocal wish to separate or divorce. This page does not set out other differences between the two because those sources do not cover them. Tell the lawyer about your situation at the first consultation and ask which option suits you and what risks it carries.
